2007-08-012024-05-14https://scholars.lib.ntu.edu.tw/handle/123456789/661236摘要:本研究擬利用日治時期豐富的統計, 建構長期地域別的追蹤資料, 對於犯罪行為進行實證分析。 我們所擬研究的罪行包括: 賭博、縱火、殺人、傷害、竊盜及強盜、詐欺等。 我們所擬提出的一般性解釋變數包括: 警力、刑罰、人口結構、平均每人所得、社會福利支出、教育支出等。 除此之外, 本計劃擬研究日治時期特殊的法律制度, 如笞刑、浮浪者取締規則等對於犯罪行為之影響。 本計劃第一年除了研讀日治時期司法與警察制度的背景之外, 將著手整理犯罪的資料, 包括被害、檢舉、一審定罪等項目, 說明日治時期台灣治安跨時的變化與地域性的差異。 第二年將整理可資解釋犯罪行為的變數資料, 並進行實證分析。 我們擬估計與檢定的包括: (1) 死刑對於殺人案之影響 (2) 笞刑對於竊盜案之影響 (3) 囚禁對於犯罪率的影響是嚇阻, 還是單純的禁錮了下一個犯人 (incapacitation)? 最後一年, 我們想根據前兩年累積的研究, 解釋犯罪率跨時與跨地的變化, 並檢討日治時期司法制度的變遷。 日治時期的司法制度漸次加入人道主義的關懷, 如廢止笞刑與減少浮浪者之取締人數, 我們想研究此一制度變遷對於犯罪行為之影響。 <br> Abstract: This research project will use the rich crime data kept in the Japanese colonial time to study the criminal behavior. We shall construct a database of panel data for various crimes including gamble, larceny, murder, assault, burglary, robbery and cheating. The variables that we shall use to explain the criminal behavior include police force, penalty, demography, real income per capital, social welfare spending, education spending etc. Moreover, we like to probe into the special legal rules in the colonial time, e.g. beating penalty and roamers' control, to see their effects on crimes. In the first year, we shall study the legal background, and compile crime data, including crime reports, prosecutions and sentences. We shall write a report about the change of crimes across time and places. In the second year, we shall compile the data that serve as explanatory variables of crime. With this, we plan to do the following empirical studies: (1) to estimate the effect of death penalty on murders (2) to estimate the effect of beating penalty on burglary (3) to test how increased arrest rates reduce crime (deterrence vs. incapacitation). Based on the first two years' studies, we shall write a report in the last year to give an overview of the legal systems and the criminal behavior in the colonial time. Our goal is to explain why crime rates vary through time and space and to evaluate the change of legal rules in the colonial time. In the late period, the Japanese Governor abolished beating penalty and reduced the arrests of roamers, thanks to humanitarian concerns.
