2005-07-132024-05-17https://scholars.lib.ntu.edu.tw/handle/123456789/681393摘要：關於「臺灣檢察制度的世紀回顧」研究計畫（以下簡稱本計畫），係由法務部所委託，本校法律學院王泰升教授主持，為期一年（2005.7～2006.6）之研究計畫案。其研究目的係試圖以人民日常生活經驗的角度，來闡釋約一世紀以來，檢察制度在臺灣社會的運作歷程。對此，除了要顯示歷來檢察官們在維護社會正義上的貢獻，本計畫另也將呈現在特定時空脈絡下，檢察官們所遭遇到的逆境。因此，在預期成果方面，本計畫的成果將不僅只於讓一般人民瞭解檢察體系的內涵，同時也將作為檢察官們在其思考自身於社會上所應扮演之角色的殷鑑。 就研究之內容方面，本計畫主要區分有「一、臺灣檢察制度的變遷史」及「二、檢察官的故事：檢察制度在臺灣的運作實況」兩部分。整體而言，係依時間順序，分別探討1.荷蘭、西班牙統治臺灣時，所引入的歐陸前近代式檢察官制度、與2.日治臺灣時，來自明治維新後的近代歐陸式檢察制度、以及3.源自清末中國的改革，並延續至中華民國，及其播遷臺灣後，同屬近代歐陸式的檢察制度。藉此釐清檢察制度在臺灣的發展歷程，及其運作過程中所呈現出之風貌。 最後，就研究方法部分，本計畫之第一部分因受限於現有學術論述及相關研究成果之不足，故於方法上，將大量仰賴對於直接史料的分析。至於第二部分，則為呈現檢察制度與社會的連結關係，除使用既有之司法統計資料，也將針對檢察人員本身，進行相關之個案研究。<br> Abstract: The purpose of this project is to interpret the development of prosecutor system in Taiwan in the 20th century, especially from the perspective of daily life of ordinary people. In addition to the contributions of prosecutors for social justice, this project wants to show the disadvantages toward prosecutors in different periods. Thus, the result of this research will allow the public general to know the contexts of prosecutor system and let Taiwan’s prosecutors reconsider what kinds of role they should play in present society. There are two parts in this project. The first one is the exploration on the evolution of prosecutor system in Taiwan, which will rely largely on historical documents. The second one is the connection between the prosecutor system and the society of Taiwan, which will be examined by the statistics of judicial affairs, interviews and case studies.
