2023-01-012024-05-18https://scholars.lib.ntu.edu.tw/handle/123456789/700904日本政府近年來希望推動「工作方式改革實行計畫」，鼓勵多樣化的工作方式，並鼓勵勞工從事副業或兼業，並於2018年通過了工作方式改革關聯法（「働き方改革を推進するための関係法律の整備に関する法律」）。由於日本政府亟欲促進副業兼業的結果，使得從事副業兼業的勞工，於複數就業的情況下，就產生了複數就業者之職業災害保險給付如何適用，如何認定職業災害以及如何決定給付額的問題。 關於此課題，日本勞動政策審議會進行了長期的審議，提出了「複數就業者相關之職業災害保險給付等」（複数事業労働者への労災保険給付）報告案，其中所建議的修正方向，並為日後勞災保險法修法時所採用。 為了完善高齡者及複數就業者之社會安全網，日本國會於2020年3月31日通過了「雇用保險法等部分修正之法律」（「雇用保険法等の一部を改正する法律」），其中基於前述報告案所建議之修正方向，進行了勞災保險法之修法，針對複數就業者之給付基礎日額的算定與給付之對象範圍的擴充進行了修正，並於2020年9月1日開始施行。 本研究欲評析日本2020年勞災保險法之修法內容，並希望借鏡本次修法的經驗，對我國即將完成立法之職業災害保險及保護法就雙重加保時之給付與職災認定，以及與其他相關給付間的關係，提供具體的建議。 In recent years, the Japanese government hopes to promote the “work style reform implementation plan”, encourage diversified work styles, and encourage laborers to engage in side jobs or part-time jobs. In 2018, it passed”ct on the Arrangement pf Related Acts to Promote Work Style Reform a world style reform related law”. As the result of the Japanese government’s eagerness to promote a side job and a part-time job, how to determine the occupational accident insurance benefits for workers engaged in a side job and a part-time job in the case of multiple employments becomes an important issue. Regarding this issue, the Labor Policy Council conducted long-term deliberation and proposed a report on “ Occupational Accident Insurance Benefits Related to Multiple Workers”. The proposed amendment direction was adopted when the Industrial Accident Compensation Insurance Act was revised. In order to Improve the social safety net for the elderly and multiple workers, the Japanese parliament passed the “the Act Partially Amending the Employment Insurance Act” on March 31,2020. Based on the proposed amendments in the aforementioned report, amendment to the Industrial Accident Compensation Insurance Act were made, and it will be implemented on September 1, 2020.
