2008-06-012024-05-17https://scholars.lib.ntu.edu.tw/handle/123456789/682937摘要：「醫事刑法案例教學研究」本計畫為教育部補助之「法學教育教學研究創新計畫」，計劃主持人為台大法律系王皇玉助理教授，協同主持人為台大法律系李茂生教授。 醫療糾紛一直是醫病關係中，醫生與病患最不願發生的事情。今日醫療糾紛日益增多，基於其專業性、特殊性，醫事法律問題實為醫界與法律界共同關心的議題。本研究計劃之目的，以強化醫事法律教育為主軸，透過實際案例的分析與討論，以建立對於醫事法律問題的邏輯思維。最終的目的，則是希望能促進醫學與法律的溝通與整合。 本研究計畫以設計醫事法律的案例教學教材與教學方法為主。在教材研發設計上，採擇已進入刑事司法程序之案例，其中包括社會注目的案例，及對醫學界影響深遠的案例，以進行個案分析。先鋪陳案例事實及理由後，將所涉法律爭議問題一一點出後，再為深入探討。教學方法部分，則以專題研討式的互動、對話教學法，首先由授課教師點出各案例重要法律爭點，再請學生自行蒐集判決資料，並開展醫學觀點的爭議問題論述。上課時，則設計以引導與問答方式進行，希望以開放式討論，激發學生就個案判決的法律見解進行思辯，並誘發學生既從醫學觀點，也從法律觀點思索同一問題，以共同探詢醫學理念與法學理念的平衡點。 <br> Abstract: Research of Case-Teaching Methods in the Education of Medical Laws The main purpose of this project is to design case-teaching material and methods of medical laws. At first, we will select some prominent cases of medical negligence which had already entered into criminal prosecution. Then we will point out related judicial issues of theses cases and discuss with other academicians who have medical backgrounds.
