2018-06-012024-05-15https://scholars.lib.ntu.edu.tw/handle/123456789/665626摘要:我國近年來推動職業災害保險法單獨立法,2014年行政院雖曾提出職業災害保險法草案,但未經立法院審議。2016年政權交替之際,蔡英文總統將職業災害保險法之單獨立法作為其勞工政策之一環,然勞動部截至目前仍尚未提出草案。 檢視現行的職業災害救濟制度,實存在著許多問題點,然其中有些問題可以透過職業災害保險法之單獨立法加以解決,惟2014年行政院版的草案,僅將職業災害從現行的勞保條例中抽離,對於法條內容,並未為太大的變更。本研究希望以職災救濟制度與我國高度相似之日本,為比較法之對象,針對目前我國勞保條例中職業災害保險所面臨的問題,例如僱用人數未滿5人之事業單位為任意加保對象、月投保薪資設有上限致保障不足、通勤災害之給付饒生爭議、職業災害認定莫衷一是、違法未納保時之處置,以及與其他各項救濟途徑間給付之調整等沉痾已久的問題,借鏡日本的經驗,就我國未來職災保險單獨立法時之制度設計,提出政策面及執行面之具體建議。 <br> Abstract: Nowadays, the legislation on Industrial Accident Insurance Act is in progress. The Executive Yuan submitted the legislation drafting of Taiwan`s Industrial Accident Insurance Act in 2014, but the legislation was or completed. In 2016, the President Ing- Wen Tsai took the legislation on Industrial Accident Insurance Act as a part of her labor policy, but the Ministry of Labor has not submitted the drafting yet. Under the existing law, there are many issues and some of them can be solved by the legislation on Industrial Accident Insurance Act. According to the legislation drafting of Taiwan`s Industrial Accident Insurance Act in 2014, the content was almost the same as the existing law and was not helpful in solving problems, such as the range of compulsory insurance, the limits of insured salary, the requirements for commuting injuries, and so on.
