2020-01-012024-05-13https://scholars.lib.ntu.edu.tw/handle/123456789/652678摘要:人工智慧(artificial intelligence, AI)逐漸進入生活的各個層面,除了帶來便利與 效率外,也對倫理、法律、社會和經濟等層面形成挑戰。本計畫將實踐AI在民事及 家事法院裁判的應用(法律資料分析,legal data analytics)具體將針對「高齡者 之財產安全與規劃」之主題,包含老親扶養、遺囑效力以及無意思能力之交易行為 之相關裁判,以AI的相關技術如文字探勘、機器學習等,分析法院裁判時重視之法 律要素(legal factor),並預測裁判結果(例如扶養費之請求有無理由、金額多寡 等)。此外,為了明瞭機器所為之資料分析的成果與限制,本計畫也將同時採用人 工標記(編碼)之法實證研究的方法,將此二成果相互比較對照。其次,上述分析 裁判之研究成果,將製成供法律從業人員(法官、檢察官、律師等)操作使用之 AI裁判分析平台,並以訪談方式評估使用者意見,亦即AI平台所提供之資訊的輔助 成效如何,並對此提出相關的反思與政策建議。本計畫之研究成果除了能在AI與法 的分野引領國際學術先機外,在實務上也有價值,亦即以平台提供裁判分析之資訊 ,可能使律師與當事人得以在提起訴訟前更有效地制定紛爭解決策略;進入法院後 ,亦可有效圍繞重要爭點攻防;法院的裁判結果由於可預測性高,亦能提升人民對 司法系統的信賴。<br> Abstract: With the remarkable developments in artificial intelligence (AI) in recent years, life has become more convenient and efficient. At the same time, AI also brings new challenges regarding ethical, legal, social and economic issues. This research will focus on the application of AI technologies to judicial decisions. First, we will explore the progress and content of legal data analytics and its connection with empirical legal studies. Next, we will focus our research on decisions regarding elders’ financial security and estate planning. Text mining and machine learning algorithms will be applied to the analysis of court decisions and further prediction of case outcomes. By utilizing the same datasets, we will compare the prediction of AI with that of legal empirical studies done by people. The outcomes of the abovementioned legal analytics will be transformed into a user-friendly interface on the internet, i.e. an AI system of legal analytics, so that legal professionals such as judges and lawyers can easily acquire insights into decisive factors in the cases before them. Finally, this study will evaluate the impact of the AI system on legal industry by interviewed to legal professionals, and make policy suggestions accordingly. As the research on AI and legal analytics is still new and relatively rare in the world, the expected achievements of this project has the potential to take a lead in this issue in the international academic community.
