2012-04-012024-05-18https://scholars.lib.ntu.edu.tw/handle/123456789/697570摘要：本研究目標在於提升我國金融法研究水準，並就如何健全我國金融市場與制度等提出具體可行的建議，以供政府與業者參考。為實現此一目標，本研究將藉由加強國際學術交流、進行跨領域研究（如結合財務金融與法律）、從事比較法制研究、提升國內金融法律水準（如透過與實務界對話之金融法論壇）等方式，奠定本研究基礎。 本研究的改善策略著重於科技整合的法學研究。法律經濟分析大師Richard Posner在一篇2002年發表於哈佛法學評論之文章：（談當前的法學研究）（Legal Scholarship Today）中，探討美國近一個世紀以來之學院法論述之發展。其中，最關鍵之一點，則是指出美國法學院自1970年代以降，學院論述已經越來越明顯趨向科技整合的法學研究。因此，在企業金融法中所運用之知識，相較於傳統法學也更須從專業技術角度思考，更應整合其他社會科學科，比如：會計、統計、經濟等分析，始能完善地掌握企業金融法制相關議題。 本研究方案係規參與老師應單獨或共同發表研究成果（包括TSSCI 與SSCI等），並施以嚴謹的執行與考核方案，以鼓勵參與教師追求卓越。整體而言，希望能於本研究實施後，除能改善我國企業金融市場與制度所存之弊病，促使相關金融法制更臻健全與完善之外，更進一步期待可使我國金融法制之研究與東亞的韓國與日本並駕齊驅。 <br> Abstract: This study aims to enhance the quality of domestic financial law research, and to provide concrete and feasible suggestions of how to improve domestic financial market and regulations for our government and industries. It will achieve these goals through different methods, including the promotion of international academic exchange, interdisciplinary research (for example, combining the researches of finance and law), comparative law research, and stimulating the domestic financial studies (for example, having discussion with the practitioners). These methods are the foundation of this study. This study focuses on the integration of technology and legal research. Richard Posner, the master of economic and laws analysis, had introduced the progress of legal research in United States. In his paper Legal Scholarship Today (Harvard Law Review, 2002), he mentioned the important fact that the law schools in United States have been integrating technology and legal research since 1970s. Compare to traditional legal research, the research of corporate financial law requires more technical approaches, which means legal research combined with other social science, for example, the analysis of accounting, statistic, or economic. By interdisciplinary research, the researchers can complete all the issues related to corporate financial law. To encourage the pursuit of excellence, the participants of this study should present their research outcomes individually or as a group (including TSSCI, SSCI, etc.), and have strict plans for execution and assessment. This research is hoped to solve the existing problems in domestic financial markets and regulations, and to improve the related financial rules and regulations.
